1. Acceptance of Terms
Welcome to Checkly! Please read the following Terms of Service carefully.
By downloading, installing, or using the Checkly application, you confirm that you have read, understood, and agree to be bound by the following terms. If you do not agree to these terms, please do not use this application.
We reserve the right to modify these terms at any time. Significant changes will be notified to you through in-app notifications or other appropriate means. Continued use of the application will be considered acceptance of the modified terms.
2. Service Description
Feature Overview
Checkly is a checklist management application that allows users to:
- Create and manage lists
- Add task groups and checkpoints to lists
- Mark task completion status
- Use AI to generate list content (with different limitations based on subscription status)
- Synchronize data through iCloud (subscription users only)
- Export data in TXT and PDF formats (subscription users only)
Platform Requirements and Compatibility
Checkly requires:
- iOS 17.6 or later
- For iCloud sync functionality: an active Apple ID and sufficient iCloud storage space
3. Accounts and Subscriptions
Free Version
The free version of Checkly includes the following features and limitations:
- Create up to 5 lists
- Up to 20 tasks per list
- Limited trial of AI generation features
- Basic data storage (local device only)
Subscription Version
Subscribing to Checkly Pro unlocks the following features:
- Unlimited number of lists and tasks
- iCloud sync backup data
- Data export in TXT and PDF formats
- Bulk task item addition
- Advanced AI generation features
Subscription Policy
Regarding subscriptions, please note the following:
- Subscriptions auto-renew unless canceled at least 24 hours before the end of the current subscription period
- Subscription management and cancellation can be done through App Store settings
- Any unused portion of a free trial period will be forfeited when purchasing a subscription
- Prices may vary by region and promotional offers
- Refund requests need to be processed through the Apple App Store, and we follow Apple's refund policy
4. Usage Rules
Permitted Use
You may use Checkly for:
- Personal and business task management
- Creating and organizing lists and tasks
- Using all features within the limits of the free or subscription version
AI Feature Smart Usage Rules
Subscription users can use the AI list generation feature unlimited times. To ensure the best experience and service stability for all users, we employ intelligent request management mechanisms.
Sending a large number of requests in a short period of time may trigger a temporary cooling period, during which you just need to wait a moment before continuing to use the service. These optimization measures are designed to ensure service quality and may be dynamically adjusted based on system load, with specific guidance provided through in-app prompts.
Prohibited Behavior
You may not:
- Attempt to circumvent any limitations or payment systems in the app
- Use automated tools to excessively use the AI generation feature
- Reverse engineer, decode, or otherwise attempt to extract the app's source code
- Use the app for any illegal or abusive purposes
- Interfere with the normal operation of the service or impose unreasonable load on the servers
- Use AI features to generate content that infringes on others' intellectual property, is illegal, or inappropriate
- Share your subscription benefits with others or allow unauthorized users to access your premium features
- Copy, distribute, or publicly display app content or features without authorization
- Attempt to collect other users' data through the app or engage in any form of phishing activity
- Use the app to collect information for developing similar or competitive products
5. Content and Data
User Content Ownership
You retain full ownership of all content created using Checkly. We do not claim any ownership rights to your lists, tasks, or other user-generated content.Data Backup
While subscription users can use iCloud sync to back up data, we recommend regularly exporting important data as an additional protection. We are not responsible for any data loss, including loss due to app failures, device issues, or synchronization errors.
Service Interruptions
We will strive to ensure continuous availability of the app and related services, but we do not guarantee uninterrupted service. Features that rely on network connections, such as AI features and cloud synchronization, may be temporarily unavailable due to server maintenance, network issues, or other reasons.
6. Legal Terms
Intellectual Property
The Checkly application, including its code, design, logos, and other content, is protected by copyright law and other intellectual property laws. Unless explicitly allowed by these terms, you may not copy, modify, distribute, or create derivative works without our prior written consent.Disclaimer
The Checkly application is provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not guarantee that the application will meet your specific requirements or that the operation of the application will be uninterrupted or error-free.
Limitation of Liability
To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, whether these damages are based on warranty, contract, tort (including negligence), or other legal theory.
Dispute Resolution
If you have any issues or concerns about our service, please contact us first ([email protected]), and we will make every effort to resolve the matter amicably. This agreement is interpreted and enforced according to Chinese law.7. Termination Terms
Account Termination
You may stop using the application or cancel your subscription through the App Store at any time. We also reserve the right to limit or terminate your access in cases of violation of these terms or abuse of services.
Subscription Cancellation
After canceling your subscription:
- You will continue to have subscription access until the end of the current billing cycle
- Afterward, your account will revert to free version features and limitations
- Data already synchronized through iCloud will continue to exist in your iCloud account, but the app will no longer synchronize with it
- Existing content exceeding free version limits will remain visible, but you cannot add new content until reducing content below free version limits
- Export features will no longer be available after subscription expiration
- AI generation features will revert to free version limitations
- You can still access and edit existing lists and tasks
- You can resubscribe at any time to restore all subscription features
Service Changes or Termination
We reserve the right to modify, suspend, or terminate the Checkly service or any part of it at any time, with or without notice. In the event of service termination, we will make reasonable efforts to notify users and allow them to export their data.
